Here It Is: The Text of Uganda’s Proposed Anti-Homosexuality Bill

We just received early this morning the full text of the proposed Anti-Homosexuality Bill that was introduced into Uganda’s Parliament yesterday. It is greatly expanded from the earlier draft dated April 20, 2009.

Like the earlier draft, the current bill reiterates a lifetime imprisonment on conviction of homosexuality, and defines a new category called “aggravated homosexuality” with provisions for the death penalty upon conviction. Among the factors which can lead to “aggravated homosexuality” is if one partner is HIV-positive. This bill would mandate HIV testing to determine eligibility for “aggravated homosexuality.”

Also like the earlier draft, the bill includes a complete ban on all LGBT activities — including blogging — which could be construed as “promoting homosexuality.” This infringement on free speech, peaceful assembly, and redress of grievances marks the elimination of fundamental human rights for LGBT Ugandans. The bill also bans all organizations which advocate on behalf of LGBT citizens and holds their leadership criminally liable with fines and imprisonment for up to seven years.

The bill also retains provisions which require that if someone knows that someone is engaging in homosexuality, that person is to report them to the police within twenty-four hours or face fines and/or up to a three year prison sentence themselves. The bill also extends jurisdiction to acts committed outside Uganda by Ugandan citizens. In other words, if a Ugandan citizen is known to be in a gay relationship outside the country, he will risk lifetime imprisonment (or death, if he’s HIV-positive) upon his return. The bill also provides for the extradition of citizens from abroad.

The bill also voids all treaties and international obligations which violate ” the spirit and provisions enshrined in this Act.”

The new bill adds some additional provisions over the previous draft. This bill adds the category of “attempted homosexuality” and provides a penalty of seven years in prison. For “attempted aggravated homosexuality,” the penalty is lifetime imprisonment. It also provides for compensation for “victims” of homosexuality, a provision in law which is sure to result in consensual partners turning against their partner to not only avoid the draconian legal penalties, but to claim the status of victim and seek compensation.

Further, the bill now adds an explicit ban on same-sex marriage. Anyone who enters into a same-sex marriage, either in Uganda or abroad, will liable for a lifetime imprisonment. New charges of “aiding and abetting homosexuality” and “conspiracy to engage in homosexuality” would carry a prison sentence of seven years. There is also a new charge for operating a brothel, with a definition so broad as to include any hotel owner. That, too, carries a prison sentence of seven years.

THE ANTI HOMOSEXUALITY BILL. 2009.

MEMORANDUM

1.1. The principle

The object of this Bill is to establish a comprehensive consolidated legislation to protect the traditional family by prohibiting (i) any form of sexual relations between persons of the same sex; and (ii) the promotion or recognition of such sexual relations in public institutions and other places through or with the support of any Government entity in Uganda or any non governmental organization inside or outside the country.

This Bill aims at strengthening the nation’s capacity to deal with emerging internal and external threats to the traditional heterosexual family.

This legislation further recognizes the fact that same sell attraction is not an innate and immutable characteristic.

The Bill further aims at providing a comprehensive and enhanced legislation to protect the cherished culture of the people of Uganda. legal, religious, and traditional family values of the people of Uganda against the attempts of sexual rights activists seeking to impose their values of sexual promiscuity on the people of Uganda.

There is also need to protect the children and youths of Uganda who are made vulnerable to sexual abuse and deviation as a result of cultural changes, uncensored information technologies, parentless child developmental settings and increasing attempts by homosexuals to raise children in homosexual relationships through adoption, foster care, or otherwise.

2.1. Defects In existing law.

This proposed legislation is designed to fill the gaps in the provisions of other laws in Uganda e.g. the Penal Code Act Cap. 120.

The Penal Code Act (CapI20) has no comprehensive provision catering for anti homosexuality. It focuses on unnatural offences under section 145 and lacks provisions for penalizing the procurement, promoting, disseminating literature and other pornographic materials concerning the offences of homosexuality hence the need for legislation to provide for charging, investigating, prosecuting, convicting and sentencing of offenders.

This legislation comes to complement and supplement the provisions of the Constitution of Uganda and the Penal Code Act Cap 120 by not only criminalizing same sex marriages but also same-sex sexual acts and other related acts.

3.0. The objectives of the Bill

The objectives of the Bill are to:

(a) provide for marriage in Uganda as that contracted only between a man and a woman;

(b) prohibit and penalize homosexual behavior and related practices in Uganda as they constitute a threat to the traditional family;

(e) prohibit ratification of any international treaties, conventions, protocols, agreements and declarations which are contrary or inconsistent with the provisions of this Act;

(d) prohibit the licensing of organizations which promote homosexuality.

3.1. Part I of the Bill incorporating clause 1 provides for preliminary mailers relating to interpretation of the words and phrases used in the Bill.

3.2. Part II of the Bill incorporating clause 2 to 6 prohibits homosexuality and related practices by introducing the offences of engaging In homosexuality, and the penalties of imprisonment upon conviction. This pan also provides for protection, assistance and support for victims of homosexuality.

3.3. Part III of the Bill incorporating clause 7 to clause 14 creates offences and penalties for acts that promote homosexuality, failure to report the offence and impose a duty on the community to report suspected cases of homosexuality.

3.4. Part IV of the Bill incorporating clause 15 to clause 17 provides for the jurisdiction of Uganda Courts in case of Homosexuality, including extra territorial jurisdiction.

3.5. Part V of the Bill incorporating clauses 18 and 19 provides for miscellaneous provisions on International Treaties, Protocols. Declarations and conventions and the Minister to make regulations to give effect to the Act.

Schedule of the Bill gives the value of the currency point.

A BILL FOR AN ACT

ENTITLED

THE ANTI HOMOSEXUALITY ACT, 2009.

An Act to prohibit any form of sexual relations between persons of the same sex; prohibit the promotion or recognition of such relations and to provide for other related matters.

BE IT ENACTED by Parliament as follows:

PART I — PRELIMINARY.

I. Interpretation.

In this Act. unless the context otherwise requires –

“authority” means having power and control over other people because of your knowledge and official position; and shall include a person who exercises religious. political, economic or social authority;

“bisexual” means a person who is sexually attracted to both males and females;

“child” means a person below the age of 18 years:

“currency point” has the value assigned to it in the Schedule to this Act;

“disability” means a substantial limitation of daily life activities caused by physical. mental or sensory impairment and environment barriers resulting in limited participation;

“felony” means an offence which is declared by law to be a felony or if not declared to be a misdemeanor is punishable without proof of previous conviction, with death or with imprisonment for 3 years or more.;

“gay”” means a male person who engages in sexual intimacy with another person of the same sex;

“‘gender”” means male or female;

“HIV” means the Human Immunodeficiency Virus;

“homosexual”‘ means a person who engages or attempts to engage in same gender sexual activity;

“homosexuality”’ means same gender or same sex sexual acts;

“lesbian” means a female who engages in sexual intimacy with another female;

“Minister’” means the Minister responsible for ethics and integrity;

“misdemeanor” means an offence which is not a felony;

“serial offender” means a person who has previous convictions of the offence of homosexuality or related offences;

“sexual act” includes –

(a) physical sexual activity that docs not necessarily culminate in intercourse and may include the touching of another’s breast, vagina, penis or anus:

(b) stimulation or penetration of a vagina or mouth or anus or any part of the body of any person, however slight by a sexual organ;

(c) the unlawful use of any object or organ by a person on another person’s sexual organ or anus or mouth;

“sexual organ” means a vagina, penis or any artificial sexual contraption;

“touching” includes touching—

(a) with any part of the body;

(b) with anything else;

(c) through anything;

and in particular includes touching amounting to penetration of any sexual organ. anus or mouth.

“victim” includes a person who is involved in homosexual activities against his or her will.

PART II — HOMOSEXUALITY AND RELATED PRACTICES.

2. The offence of homosexuality.

(1) A person commits the offence of homosexuality if-

(a) he penetrates the anus or mouth of another person of the same sex with his penis or any other sexual contraption;

(b) he or she uses any object or sexual contraption to penetrate or stimulate sexual organ of a person of the same sex;

(e) he or she touches another person with the intention of committing the act of homosexuality.

(2) A person who commits an offence under this section shall be liable on conviction to imprisonment for life.

3. Aggravated homosexuality.

(1) A person commits the offense of aggravated homosexuality where the

(a) person against whom the offence is committed is below the age of 18 years;

(b) offender is a person living with HIV;

(c) offender is a parent or guardian of the person against whom the offence is committed;

(d) offender is a person in authority over the person against whom the offence is committed;

(e) victim of the offence is a person with disability;

(f) offender is a serial offender, or

(g) offender applies, administers or causes to be used by any man or woman any drug, matter or thing with intent to stupefy overpower him or her so as to there by enable any person to have unlawful carnal connection with any person of the same sex,

(2) A person who commits the offence of aggravated homosexuality shall be liable on conviction to suffer death.

(3) Where a person is charged with the offence under this section, that person shall undergo a medical examination to ascertain his or her HIV status.

4, Attempt to commit homosexuality.

(1) A person who attempts to commit the offence of homosexuality commits a felony and is liable on conviction to imprisonment seven years.

(2) A person who attempts to commit the offence of aggravated homosexuality commits an offence and is liable on conviction to imprisonment for life.

5. Protection, assistance and payment of compensation to victims of homosexuality.

(1 ) A victim of homosexuality shall not be penalized for any crime commuted as a direct result of his or her involvement in homosexuality.

(2) A victim of homosexuality shall be assisted to enable his or her views and concerns to be presented and considered at the appropriate stages of the criminal proceedings.

(3) Where a person is convicted of homosexuality or aggravated homosexuality under sections 2 and 3 of this Act, the court may, in addition to any sentence imposed on the offender, order that the victim of the offence be paid compensation by the offender for any physical, sexual or psychological harm caused to the victim by the offence.

(4) The amount of compensation shall be determined by the court and the court shall take into account the extent of harm suffered by the victim of the offence. the degree of force used by the offender and medical and other expenses incurred by the victim as a result of the offence.

6. Confidentiality.

(1) At any stage of the Investigation or trial of an offence under this Act, law enforcement officers, prosecutors, judicial officers and medical practitioners, as well as parties to the case, shall recognize the right to privacy of the victim.

(2) For the purpose of subsection (I), in cases involving children and other cases where the court considers it appropriate. proceedings of the court shall be conducted in camera, outside the presence of the media.

(3) Any editor or publisher, reporter or columnist in case of printed materials. announcer or producer in case of television and radio, producer or director of a film to case of the movie industry. or any person utilizing trimedia facilities or information technology who publishes or causes the publicity of the names and personal circumstances or any other information tending to establish the victim’s identity without authority of court commits an offence and is liable on conviction to a fine not exceeding two hundred and fifty currency points.

7. Aiding and abating homosexuality

A person who aids, abets, counsels or procures another to engage in acts of homosexuality commits an offence and is liable on conviction to imprisonment for seven years.

8. Conspiracy to engage in homosexuality.

A person who conspires with another to induce another person of the same sex by any means of false pretence or other fraudulent means to permit any person of the same sex to have unlawful carnal knowledge of him or her commits an offence and is liable on conviction to imprisonment for seven years.

9. Procuring homosexuality by threats, etc.

(1) A person who–

(a) by threats or intimidation procures or attempts to procure any woman or man to have any unlawful carnal knowledge with any person of the same sex, either in Uganda or elsewhere;

(b) by false pretences or false representations procures any woman or man to have any unlawful carnal connection with any person of the same sex, either in Uganda or elsewhere; or

(2) A person shall not be convicted of an offence under this section upon the evidence of one witness only, unless that witness is corroborated in some material particular by evidence implicating the accused.

10. Detention with intent to commit homosexuality.

A person who detains another person with the intention to commit acts of homosexuality with him or herself or with any other person commits an offence and is liable on conviction for seven years.

11. Brothels.

(1) A person who keeps a house, room,set of rooms or place of any kind for the purposes of homosexuality commits an offence and is liable on conviction to imprisonment for seven years.

2) A person being the owner or occupier of premises or having or acting or assisting in the management or control of the premises, induces or knowingly suffers any man or woman to resort to or be upon such premises for the purpose of being unlawfully and carnally known by any man or woman of the same sex whether such carnal knowledge is intended to be with any particular man or woman generally, commits a felony and is liable on conviction to imprisonment for five years.

12. Same sex marriage.

A person who purports to contract a marriage with another person of the same sex commits the offence of homosexuality and shall be liable on conviction to imprisonment for life.

13. Promotion of homosexuality.

(1) A person who –

(a) participates in production. procuring, marketing, broadcasting, disseminating, publishing pornographic materials for purposes of promoting homosexuality;

(b) funds or sponsors homosexuality or other related activities;

(c) offers premises and other related fixed or movable assets for purposes of homosexuality or promoting homosexuality;

(d) uses electronic devices which include internet, films, mobile phones for purposes of homosexuality or promoting homosexuality and;

(e) who acts as an accomplice or attempts to promote or in any way abets homosexuality and related practices;

commits an offence and is liable on conviction to a line of live thousand currency points or imprisonment of a minimum of five years and a maximum of seven years or both fine and imprisonment.

(2) Where the offender is a corporate body or a business or an association or a non-governmental organization, on conviction its certificate of registration shall be cancelled and the director or proprietor or promoter shall be liable on conviction to imprisonment for seven years.

14. Failure to disclose the offence.

A person in authority, who being aware of the commission of any offence under this Act, omits to report the offence to the relevant authorities within twenty-four hours of having first had that knowledge, commits an offence and is liable on conviction to a fine not exceeding two hundred and fifty currency points or imprisonment not exceeding three years.

PART IV — JURISDICTION

15. Jurisdiction.

Save for aggravated homosexuality that shall be tried by the High Court, the magistrates court shall have jurisdiction to try the other offences under this Act.

16. Extra- Territorial Jurisdiction.

This Act shall apply to offenses committed outside Uganda where –

(a) a person who, while being a citizen of or permanently residing in Uganda, commits an act outside Uganda, which act would constitute an offence under this Act had it been committed in Uganda; or

(b) the offence was committed partly outside and or partly in Uganda.

17. Extradition.

A person charged with an offence under this Act shall be liable to extradition under the existing extradition laws.

PART V — MISCELLANEOUS.

18. Nullification of inconsistent international treaties, protocols, declarations and conventions.(1) Any International legal instrument whose provisions are contradictory to the spirit and provisions enshrined in this Act, are null and void to the extent of their inconsistency.

(2) Definitions of “sexual orientation”, “sexual rights”, “sexual minorities”, “gender identity” shall not be used in anyway to legitimize homosexuality, gender identity disorders and related practices in Uganda.

19. Regulations.

The Minister may, by statutory instrument. make regulations generally for better carrying out the provisions of this Act.

SCHEDULE

Full Apologies… and forgivness

This site is intense. What if you drove drunk, and killed your friend? It is easy to judge someone over a mistake that is so tradgic. There are victims… and sometimes even the person who committed the crime… becomes a victim of guilt and shame.

The News is the Bomb!

I received a call about 11:30 Sunday stating that some had vandalized a news rack. I was a bit annoyed as I was up all night and was trying to get some sleep. I called the police who connected me to the officer on the scene.

“It looks like it was pried open and then set on fire.” The officer said.

I laughed.

He took more info from me like the value of the rack and then stated, “It looks as if it was a victim of a hate crime.”

I had to laugh again as that was about as funny thing I have heard in a long time.

Yet as it turns out, the business where the rack was, had been vandalized before.

Here are a couple of articles the first one is from a local T.V. station the second one from the Gazette where I work.

Now, when I arrived to pick it up, it looked to me like someone had placed a small explosive in it that blew out the bottom and the door the fell off. Inside you can see the burned papers.

It was funny yet also a bit unsettling to think someone would blow up a news rack because he or she hated the owner of the business because he is black. Billings had something like this happen a few years ago and the city stood up against it. I hope Billings will do that again.

I am going to just ask this open question.
I have read much of Ken Silva’ “false” accusations against many… yet I am wondering what are the specific things Ken holds against Tony?
Now, if you use the “Tony used the “f” word… I will remind you Ken you used the headline,and the quote many more times than Tony has… and in fact I am on record as asking Tony to tame down his language… so let’s move on from that one.
Yet, how can you justify the name calling?
What are the facts behind these “names”… that make them so true?
I am holding this out so that you can state your case. So far I see these as slander and lies… but then, it seems you thrive on those things.
So, without making this all about me… let’s talk about Tony Jones… and all the facts (which seemed to become opinions as of late) that you have piling up against him.

I’m not your critic, don’t even know you. If your involved in the Vineyard movement, I’ll just consider that you have not come to your right mind.

My question has to do with your introductory comment:

“I find it rather strange how some will demand perfect doctrine from others…”

How do you square that with:

I have applied all these things to myself and Apollos for your benefit, brothers, that you may learn by us not to go beyond what is written, that none of you may be puffed up in favor of one against another…and

…As each has received a gift, use it to serve one another, as good stewards of God’s varied grace: 11 whoever speaks, as one who speaks oracles of God…and

…knowing this first of all, that no prophecy of Scripture comes from someone’s own interpretation…and

… Do not add to his words,
lest he rebuke you and you be found a liar…and

…I warn everyone who hears the words of the prophecy of this book: if anyone adds to them, God will add to him the plagues described in this book….

Though no one can demand you must believe perfect doctrine and hold it, the Scripture does. It does it in this way. That which is opinion is not truth. Only that which can be established as true is to be taught. That is what Paul and Peter, Solomon and Jesus were saying: Do not go beyond what is written. Simply, and profound. The rule is this, if you do not know it to be the truth and the only truth, keep your mouth shut, or as Proverbs would say: Even a fool is counted wise when he remains silent, or a fool does not wait to hear the end of a matter before speaking. There are sound words to learn and if there are not, then we have no Bible, even a poorly translated one to refer to.

I will leave you with this:
Teach and urge these things. If anyone teaches a different doctrine and does not agree with the sound words of our Lord Jesus Christ and the teaching that accords with godliness, he is puffed up with conceit and understands nothing. He has an unhealthy craving for controversy and for quarrels about words, which produce envy, dissension, slander, evil suspicions, and constant friction among people who are depraved in mind and deprived of the truth, imagining that godliness is a means of gain…So then, brothers, stand firm and hold to the traditions that you were taught by us, either by our spoken word or by our letter…I appeal to you, brothers, to watch out for those who cause divisions and create obstacles contrary to the doctrine that you have been taught; avoid them…charge certain persons not to teach any different doctrine…If you put these things before the brothers, you will be a good servant of Christ Jesus, being trained in the words of the faith and of the good doctrine that you have followed…Command and teach these things. Let no one despise you for your youth, but set the believers an example in speech, in conduct, in love, in faith, in purity. Do not neglect the gift you have, which was given you by prophecy when the council of elders laid their hands on you. Practice these things, immerse yourself in them, so that all may see your progress. Keep a close watch on yourself and on the teaching. The fact is iggy, the Word of God, that is Jesus Himself (ref Revelation) commands us to hold perfect doctrine. It is a simple thing, as I said. Stay within the bounds of what you know. To do more or less is to condemn yourself: “Either make the tree good and its fruit good, or make the tree bad and its fruit bad, for the tree is known by its fruit. You brood of vipers! How can you speak good, when you are evil? For out of the abundance of the heart the mouth speaks. The good person out of his good treasure brings forth good, and the evil person out of his evil treasure brings forth evil. I tell you, on the day of judgment people will give account for every careless word they speak, for by your words you will be justified, and by your words you will be condemned.”

To put it in the language of the emergent, get your pompous head out of your posterior cavity and come into the light…

Sorry for the crudeness, but these are straight forward statements of Scripture all agreeing with one another, simple enough that even a child can understand them. I have simple words for my children: The world is not pink, your head is not your butt, and don’t piss on a flat rock. Crude but effective with children and all Biblical, in a weird sort of way. I would not preach it that way except to my kids. They understand it though.

One last thing: What do you have that you did not receive?

I received this in the comments on my post My last words to my HYPER CRITICS . Originally I posted a comment back but then decided not to… but I have decided to let you the reader read this and post your comments to this person.

I’m not your critic, don’t even know you. If your involved in the Vineyard movement, I’ll just consider that you have not come to your right mind.

My question has to do with your introductory comment:

“I find it rather strange how some will demand perfect doctrine from others…”

How do you square that with:

I have applied all these things to myself and Apollos for your benefit, brothers, that you may learn by us not to go beyond what is written, that none of you may be puffed up in favor of one against another…and

…As each has received a gift, use it to serve one another, as good stewards of God’s varied grace: 11 whoever speaks, as one who speaks oracles of God…and

…knowing this first of all, that no prophecy of Scripture comes from someone’s own interpretation…and

… Do not add to his words,
lest he rebuke you and you be found a liar…and

…I warn everyone who hears the words of the prophecy of this book: if anyone adds to them, God will add to him the plagues described in this book….

Though no one can demand you must believe perfect doctrine and hold it, the Scripture does. It does it in this way. That which is opinion is not truth. Only that which can be established as true is to be taught. That is what Paul and Peter, Solomon and Jesus were saying: Do not go beyond what is written. Simply, and profound. The rule is this, if you do not know it to be the truth and the only truth, keep your mouth shut, or as Proverbs would say: Even a fool is counted wise when he remains silent, or a fool does not wait to hear the end of a matter before speaking. There are sound words to learn and if there are not, then we have no Bible, even a poorly translated one to refer to.

I will leave you with this:
Teach and urge these things. If anyone teaches a different doctrine and does not agree with the sound words of our Lord Jesus Christ and the teaching that accords with godliness, he is puffed up with conceit and understands nothing. He has an unhealthy craving for controversy and for quarrels about words, which produce envy, dissension, slander, evil suspicions, and constant friction among people who are depraved in mind and deprived of the truth, imagining that godliness is a means of gain…So then, brothers, stand firm and hold to the traditions that you were taught by us, either by our spoken word or by our letter…I appeal to you, brothers, to watch out for those who cause divisions and create obstacles contrary to the doctrine that you have been taught; avoid them…charge certain persons not to teach any different doctrine…If you put these things before the brothers, you will be a good servant of Christ Jesus, being trained in the words of the faith and of the good doctrine that you have followed…Command and teach these things. Let no one despise you for your youth, but set the believers an example in speech, in conduct, in love, in faith, in purity. Until I come, devote yourself to the public reading of Scripture, to exhortation, to teaching. Do not neglect the gift you have, which was given you by prophecy when the council of elders laid their hands on you. Practice these things, immerse yourself in them, so that all may see your progress. Keep a close watch on yourself and on the teaching. Persist in this, for by so doing you will save both yourself and your hearers…

The fact is iggy, the Word of God, that is Jesus Himself (ref Revelation) commands us to hold perfect doctrine. It is a simple thing, as I said. Stay within the bounds of what you know. To do more or less is to condemn yourself: “Either make the tree good and its fruit good, or make the tree bad and its fruit bad, for the tree is known by its fruit. You brood of vipers! How can you speak good, when you are evil? For out of the abundance of the heart the mouth speaks. The good person out of his good treasure brings forth good, and the evil person out of his evil treasure brings forth evil. I tell you, on the day of judgment people will give account for every careless word they speak, for by your words you will be justified, and by your words you will be condemned.”

To put it in the language of the emergent, get your pompous head out of your posterior cavity and come into the light…

Sorry for the crudeness, but these are straight forward statements of Scripture all agreeing with one another, simple enough that even a child can understand them. I have simple words for my children: The world is not pink, your head is not your butt, and don’t piss on a flat rock. Crude but effective with children and all Biblical, in a weird sort of way. I would not preach it that way except to my kids. They understand it though.

Does God “hate” people?

Does God “hate” people?

Every once in a while I run across those who teach how God hates mankind for their sin. I think this runs against the teachings that are clear as John 3:16 states “God so loved the world…” and many other verses about God’s unconditional love.

Yet, one verse that is often used is Psalms 5:5 which is rendered in the King James Bible
The foolish shall not stand in thy sight: thou hatest all workers of iniquity.

Even the NIV states: 5. The arrogant cannot stand in your presence; you hate all who do wrong.

Now, this seems to be clear that God “hates” some people so I think we need a bit of perspective as to who is hated and how this is so.

One version I found rendered the verse this way:

Neither shall the wicked dwell near thee: nor shall the unjust abide before thy eyes.

Now, God hates sin. I think all agree that God hated sin so much He sent His Son who knew no sin to become sin for us… and in that as Jesus died on the Cross so did our sin.

Yet, there are those who dwell in injustice. They live their lives such that to bring hardship and injustice to others the do not know love. In a sense as harsh as this sounds, they have become less than human in their own devaluing of other humans. God hates iniquity, and that one would bring harm to others for their own pleasure shows that they are far from God and so God has turned them over to a depraved mind as Romans 1 teaches.

Now, can these be saved? Yes… undoubtedly. Yet, if one’s heart is so hardened that they cannot respond to God, then they will receive that due justice and penalty for their death.

Saying this, one must understand also that some place “God hates sinners” in a wrong context. They place this on those they deem are not keeping the Law, or even the standard of righteousness that they have declared as making one “worthy” of God’s grace. This is a travesty against God and His Grace as God has chosen even the worst of sinners to change and become sons of God.

In the OT if one was against God, as the Promise to Abraham states, “I will bless those who bless you and curse those who curse you.”, so those who oppose God or those He loves are dealt with because of that promise. The flip side is that the Gentiles were also to be blessed by Abraham as God promise to bless all Nations through Abraham.

Now, the issue is that if one is so proud or arrogant that they oppose God, then God will oppose them, though idea is resisting the proud and giving grace to the humble.

Yet, the promise that the Gentile was blessed was fulfilled by Jesus. So in that fulfillment, God sees all men only through Jesus and that all men “in Christ Jesus” are seen as if they are Jesus themselves for Jesus has become our righteousness and we the very righteousness of God, in Christ.

Things are changed. For even the Apostle Paul, while still Saul, violently opposed the Christians and proudly even stood by during the murder of Stephen. He asked for permission to go to other cities to destroy this “cult” called Christianity.

Yet, the Holy Spirit, which is God’s Spirit of Grace, (Heb 10:19) was poured out on all mankind on the Day of Pentecost. As this was the one thing that now opens all men to be able to turn to God, the only “sin” now that man will be judged by is what they have done or not done with Jesus. If they have not come to belief, they then will be dealt with by God on their own righteousness, and those who believe will have their name in the Lamb’s Book of Life.

In other words, we who believes will be spoken for by Jesus who is now our mediator.

God does hate sin, yet the issue is not whether mankind is held to Old Testament standards but whether man is held to New Testament standards. Does God resist the proud? Yes. Yet the issue is that as they resist Him, God turns them over to their own way. God has always given grace to the humble… yet the mark of true humility is the acceptance of Jesus and the rejection of our own way.

So, God now loves the sinner but hates the sin, He hated sin so much he sent His Son who knew no sin, to become sin… and as Jesus died on the Cross, Sin was judged and also died on the Cross.

Jesus now holds the Keys to death and Hades…

Romans 8:1 -14 speaks clearly of how sin and death are dealt with in the Believer and that the unbeliever still lives under the Law of sin and death and so will still experience death even though sin is dealt with.

“Therefore, there is now no condemnation for those who are in Christ Jesus, because through Christ Jesus the law of the Spirit of life set me free from the law of sin and death. For what the law was powerless to do in that it was weakened by the sinful nature, God did by sending his own Son in the likeness of sinful man to be a sin offering. And so he condemned sin in sinful man, in order that the righteous requirements of the law might be fully met in us, who do not live according to the sinful nature but according to the Spirit.
Those who live according to the sinful nature have their minds set on what that nature desires; but those who live in accordance with the Spirit have their minds set on what the Spirit desires. The mind of sinful man is death, but the mind controlled by the Spirit is life and peace; the sinful mind is hostile to God. It does not submit to God’s law, nor can it do so. Those controlled by the sinful nature cannot please God. You, however, are controlled not by the sinful nature but by the Spirit, if the Spirit of God lives in you. And if anyone does not have the Spirit of Christ, he does not belong to Christ.

But if Christ is in you, your body is dead because of sin, yet your spirit is alive because of righteousness. And if the Spirit of him who raised Jesus from the dead is living in you, he who raised Christ from the dead will also give life to your mortal bodies through his Spirit, who lives in you.
Therefore, brothers, we have an obligation–but it is not to the sinful nature, to live according to it. For if you live according to the sinful nature, you will die; but if by the Spirit you put to death the misdeeds of the body, you will live, because those who are led by the Spirit of God are sons of God.”

Now even though sin was dealt with if one still lives as if it was not, then they will die though their sins forgiven… for as 2 Corinthians states in chapter 5: 10-21

“For we must all appear before the judgment seat of Christ, that each one may receive what is due him for the things done while in the body, whether good or bad. Since, then, we know what it is to fear the Lord, we try to persuade men. What we are is plain to God, and I hope it is also plain to your conscience.
We are not trying to commend ourselves to you again, but are giving you an opportunity to take pride in us, so that you can answer those who take pride in what is seen rather than in what is in the heart. If we are out of our mind, it is for the sake of God; if we are in our right mind, it is for you. For Christ’s love compels us, because we are convinced that one died for all, and therefore all died. And he died for all, that those who live should no longer live for themselves but for him who died for them and was raised again. So from now on we regard no one from a worldly point of view. Though we once regarded Christ in this way, we do so no longer. Therefore, if anyone is in Christ, he is a new creation; the old has gone, the new has come!
All this is from God, who reconciled us to himself through Christ and gave us the ministry of reconciliation: that God was reconciling the world to himself in Christ, not counting men’s sins against them. And he has committed to us the message of reconciliation.
We are therefore Christ’s ambassadors, as though God were making his appeal through us. We implore you on Christ’s behalf: Be reconciled to God. God made him who had no sin to be sin for us, so that in him we might become the righteousness of God.”

The man that walks outside of reconciliation, and by the old nature of sin and death, will have to be judged according to the deeds done while in the body… yet so will those in Christ. Again the difference will be only in what they have done with Jesus. Accept Him and receive eternal life or having rejected Him will be tossed in the Lake of fire to be destroyed…

The Words of John should be a warning… John 3:35-36

“The Father loves the Son and has placed everything in his hands. Whoever believes in the Son has eternal life, but whoever rejects the Son will not see life, for God’s wrath remains on him. “

For God once judge men, but now men are judged by the words of Jesus…

John 12:47-50
“As for the person who hears my words but does not keep them, I do not judge him. For I did not come to judge the world, but to save it. There is a judge for the one who rejects me and does not accept my words; that very word which I spoke will condemn him at the last day. For I did not speak of my own accord, but the Father who sent me commanded me what to say and how to say it. I know that his command leads to eternal life. So whatever I say is just what the Father has told me to say.”

Now those who do evil do not know love, and the way to know Love is to be Loved and God is Love. Love does not cause harm to others and will seek to do what is best for others. It is this love as 2 Cor 5:14-16 tells us “For Christ’s love compels us, because we are convinced that one died for all, and therefore all died. And he died for all, that those who live should no longer live for themselves but for him who died for them and was raised again. So from now on we regard no one from a worldly point of view. Though we once regarded Christ in this way, we do so no longer.”

We no longer view one man evil and another righteous, rather that all men are sinners in need of reconciliation to God through Jesus. We now are compelled as true believers to Love others and motivate us to tell others they are reconciled at the Cross and are not able to receive eternal Life in Jesus.

Does God still hate sinners, not since Jesus died for them… yet some will still place themselves under the OT covenant with death, and receive that covenants rewards without Jesus. God’s wrath will be poured out on all that is not “in Christ”… and this world will be purged of all that is not of Christ Jesus… all that is not of Grace and Truth will perish and all that is of Grace and Truth will have eternal Life in Christ Jesus. Those who choose to not be in Christ will perish as they reject the One Way of Life or their own and in that be judged with all things not in Christ Jesus.

It is a hard word, but still it is not God Who now judges, but what one does with the Word of God and whether they accepted the Life of Christ or not.

A dead man needs Life… even a forgiven dead man still needs life… and the Life is in the Son.

The one who teaches that God still “hates the sinner” is teaching a mixture of Law and Grace and perverting the purity of Grace and the message of the New Testament…
